Madonna’s Legal Team Seeks Dismissal of Lawsuit Regarding Delayed Concert

The Celebrity Tour stop at Barclays Center in Brooklyn began late, according to two concertgoers, and Madonna’s attorneys are attempting to have the lawsuit dismissed on the grounds of “false advertising.” According to court documents obtained, Madonna’s legal team filed a motion this week to dismiss the lawsuit against Live Nation, which was filed against her nearly three months ago.

According to previously obtained documents, the concertgoers claimed in the initial lawsuit that the 13th December show started at 10:30 p.m. rather than the scheduled 8:30 p.m. start time. They contended that they would not have bought tickets if they had been aware of the delay.

It was said by the fans that the delay happened again during the two following Brooklyn shows on 14th December  and 16th December, calling it “false advertising, negligent misrepresentation, and unfair and deceptive trade practices.”

The fans’ experiences, according to Madonna’s attorneys, do not justify taking legal action. They argue that the plaintiffs’ worries, like having trouble getting a ride or having to get up early the next day, don’t amount to actionable harm.

One of the concertgoers had posted on Facebook before filing the lawsuit, calling the performance “amazing,” which, according to Madonna’s legal team, suggests that the performance either met or surpassed his expectations.

The legal team for Madonna also pointed out in their response that there was no mention of Madonna performing at 8:30 p.m. in any of the advertisements. They argue that concertgoers are aware that opening acts sometimes perform earlier in the evening before the main act takes the stage.

Furthermore, Madonna’s attorneys emphasized that the singer gave a full-length, excellent performance to her fans, and they did not report any complaints about her show.

Within 30 days, the plaintiffs’ counsel plans to reply to Madonna’s move to dismiss, reaffirming their resolve to pursue the lawsuit and recover damages for ticket buyers who want their money back.
